Annex D to the Data Processing Agreement — Mynder AS and the end customer
When this annex applies
This annex applies when the customer has given a partner access to administer or assist with the customer's workspace in the Mynder platform.
The partner is not a party to this data processing agreement and is not a sub-processor of Mynder AS, unless specifically agreed and the partner is listed in Annex B.
Terms when using a partner
When the customer uses a partner, the following applies:
The partner's access must be authorised by the customer and limited to what the customer has allowed the partner to perform. If the partner processes personal data on behalf of the customer, the customer is responsible for ensuring a valid legal basis, including a data processing agreement where required under data protection law.
The partner's access does not give the partner independent ownership or control over the customer's data. The partner cannot delete, lock, withhold or otherwise prevent the customer's access to its own data, unless the customer has expressly instructed this within the scope of the Service.
Relevant partner actions in the customer's workspace shall be logged to ensure traceability and shall be available to the customer through the functionality of the Service.
If the relationship between the customer and the partner ends, the customer retains its data, its Trust Profile and its workspace with Mynder AS. The partner's access can be removed without the customer's data or history having to be moved or recreated.
If the customer or the partner connects the Mynder platform to a system owned or operated by the partner or a third party, for example a backup or device management tool, this does not in itself make the supplier of that external system a sub-processor of Mynder AS. Mynder AS is not a contracting party with such suppliers unless they are specifically engaged by Mynder and listed in Annex B. The customer and the partner are responsible for the necessary agreements and instructions relating to the external system. Personal data that is actually transferred to the Mynder platform is processed by Mynder AS in accordance with this data processing agreement.
